@complainthub the response from pio of PHE jal shakti department is quite void and biasis where they taking the edge of 7(9) of the RTI act by refusing to explore the data on voluminous basis for the 1.5 water pipe laid under JJM before 2 years still not used for public purpose and mostly dignified the illegality of water connections or valves on the already laid 1 inch pipe to fenowing the benefits to apple orchards which is total shameful just justified their illegality to legality now please what can I do if I am goig to appeal then please provide a complete format of first appeal and under whome I addressed it

Dear @Fayaz

PIO’s response under Section 7(9) RTI Act denies data on unused 1.5" JJM pipe & illegal orchard connections on 1" pipe as ‘voluminous’, justifying irregularities. Appeal to First Appellate Authority (FAA): Executive Engineer, PHE Division Anantnag (PIO’s immediate senior).

First Appeal Format (Send by post/speed post or online rtionline.jk.gov.in within 30 days of PIO reply):

Subject: First Appeal under Section 19(1) of RTI Act 2005 – Deemed refusal / Unsatisfactory reply by PIO, PHE Sub-Division Kokernag (RTI dated [DD/MM/YY], Reg: [No]).

Respected Sir,

  1. Vide RTI dated [date], submitted to PIO, PHE Sub-Division Kokernag, sought:
  • Status/inspection reports of 1.5" pipe laid under JJM 2 yrs ago, unused for public.
  • Details of illegal valves/connections on 1" pipe benefiting apple orchards. [Attach RTI copy]
  1. PIO’s reply dated [date from images] refuses info citing Section 7(9) ‘voluminous’, provides no records, biasedly legitimizes illegality without evidence. [Attach PIO reply & images]
  2. Grounds of Appeal:
  • Section 7(9) inapplicable to specific public records under JJM; PIO must segregate non-voluminous data.
  • Reply evasive, opinionated; violates Section 7(8),(9); public interest overrides.
  • Deemed denial for incomplete info.

Relief Sought:

  • Direct PIO to furnish complete info with certified copies.
  • Hear appeal, impose penalty u/s 20(1) on PIO.
  • Daily fee u/s 7(3) from due date.

Enclosures: 1. RTI application. 2. PIO reply. 3. Proof of submission. 4. Images.
