Complaint Regarding Unauthorized and Unsafe Grill Installation Ashish Nagtilak 9022439198

I would like to bring to your attention a serious safety concern regarding an unauthorized grill structure installed beneath our residential building near Diva Railway Station, Thane.
The said grill appears to have been erected by a nearby shopkeeper without proper authorization. It is placed in a manner that poses a significant risk to residents, pedestrians, and vehicles, as it is unstable and obstructs the common area.
I would also like to highlight that my personal vehicle is parked in close proximity to this structure, which further increases the risk of damage or accidents. Additionally, this obstruction is creating a safety hazard for people commuting on the road, affecting the free and safe movement of pedestrians and vehicles.
Despite multiple requests, the concerned individual has not taken any action to remove the structure.
I kindly request your immediate intervention to inspect the site and take necessary action to remove the unauthorized installation at the earliest, in the interest of public safety.
Please treat this matter as urgent and confirm once appropriate action has been initiated.
Thank you for your prompt attention to this issue.

Dear @Ashish_Nagtilak,

We understand your concern regarding the unauthorized and unsafe grill installation. Such installations not only violate building safety codes but can also pose severe hazards to other residents and the structural integrity of the building.

To address this issue legally and effectively, please take the following steps:

1. Thane Municipal Corporation (TMC) Anti-Encroachment Dept:
Because the shopkeeper has illegally erected a structure that encroaches upon the common area and public road, you must file a formal complaint with the TMC’s Anti-Encroachment Department.

  • Online: Register your grievance using the DigiThane app or via the official TMC web portal (thanecity.gov.in). Select the “Encroachment” or “Unauthorized Construction” category.
  • Helpline: You can also log the issue via the TMC Toll-Free Grievance Helpline at 1800-222-108.

2. File a Written Complaint at Diva Police Station:
Since the structure is a severe public nuisance, restricts free movement, and the shopkeeper is uncooperative, submit a formal written complaint to your local Diva Police Station. State clearly that the unstable structure is a safety hazard threatening pedestrians and private property. Request them to intervene and file a Non-Cognizable (NC) report regarding the public nuisance and endangerment.

3. Escalate via the Aaple Sarkar Portal:
If the local TMC ward office delays the inspection or removal process, you should escalate the matter to the state level. File a grievance on the Government of Maharashtra’s Aaple Sarkar portal (aaplesarkar.mahaonline.gov.in). This portal forces municipal bodies to respond and resolve civic issues within a mandated timeframe.

4. Notify the Housing Society / RWA:
If the shop is part of your residential building’s commercial premises, submit a formal written letter to your managing committee. They have the legal standing to issue a strict warning or legal notice to the shop owner for violating society bye-laws and altering the building premises.

Make sure to attach clear photographs of the unstable grill from multiple angles, clearly showing how it obstructs the pathway and endangers vehicles, when you submit these complaints.
