while submitted RTI application on jk RTI online portal the response were given with stipulated period of time then after submitted first appeal on same concern the response from the concerned department takes a time what can I do
Dear @Fayaz If the First Appellate Authority hasn’t decided within 30 days (extendable to 45 with written reasons), treat it as deemed refusal and proceed to the next step.
File a Second Appeal within 90 days (from when the FAA order was due/received) to the Central Information Commission, which hears RTI cases for UT of J&K. Further, submit it online via the CIC/RTI Online portal; attach your RTI, PIO reply (if any), First Appeal, and proof of filing/delay.
If no FAA order after 45 days, you may also file a Complaint under Section 18 to CIC for non-disposal. You may use JK RTI portal only for applications and first appeals; second appeals/complaints must be filed with CIC.
