Dear @Fayaz
The PIO of Jal Shakti (Irrigation) Division, Anantnag, has issued an order dated 24-09-2025 under Section 7(1) disposing of the RTI request, so the application is treated as replied/closed at the department with the statutory remedy of a First Appeal within 30 days to the Superintending Engineer, Hydraulics Circle, Anantnag. The order narrates encroachment inspections and temporary demolition, references RDD Achabal, and then disposes the case while stating the applicant may file a First Appeal, indicating contradictions that can be challenged at the appellate stage.
What happened
- The PIOâs speaking order acknowledges encroachment-related issues on irrigation watercourses, mentions action like temporary demolition and need for police support, and then concludes the case as disposed, offering the First Appeal route within 30 days to the named FAA.
- A Section 7(1) disposal means the PIO has responded within the RTI frameworkâs 30âday limit, but the adequacy of information can still be contested before the FAA under Section 19(1).
Immediate steps you can take
- File a First Appeal on the J&K RTI online portal to the First Appellate Authority named in the order, within 30 days from receipt of the PIOâs decision, citing the registration number and attaching the impugned order.
- Frame grounds that the reply is unsatisfactory and opinionated, and that precise records were not supplied; under RTI the PIO must provide âinformationâ (records) rather than narrative justifications or opinions.
- Explicitly seek record inspection and certified copies; the RTI Actâs Section 2(j) permits inspection of works/records and taking certified copies/samples.
- If some records lie with RDD Achabal, insist on transfer under Section 6(3) within five days for those parts, and ask the FAA to direct such transfer if not done by the PIO.
What you should ask for
- Certified copies of all encroachment/inspection reports, site sketches, photographs, and measurement notes prepared by Jal Shakti/RDD for the specific watercourse and adjoining fields, instead of general statements.
- Copies of demolition/removal notices, warning notices issued to encroachers, and any requisitions sent to police or district administration for protection or machinery, with dispatch numbers and dates.
- File notings, actionâtaken notes, and correspondence between Jal Shakti, RDD Achabal, Revenue/Tehsildar, and district authorities regarding the encroachment and obstruction complaints, including any decisions claiming âbeneficiaries are satisfiedâ.
- Permission to inspect the full case file under Section 2(j) and obtain certified copies of selected pages and site registers/MB entries.
Escalation timeline
- The FAA must decide the First Appeal within 30 days, extendable to 45 days with written reasons, failing which the matter can be escalated further.
- If the FAAâs decision is not received or is unsatisfactory, file a Second Appeal within 90 days to the Central Information Commission, which has jurisdiction over the UT of Jammu & Kashmir after the 2019 reorganization.
- In cases of no response, misleading/incomplete information, or refusal, a complaint under Section 18 can also be filed directly with the Commission in addition to or instead of a Second Appeal, as per FAQs and Commission procedures.
To track your RTI, Log in to the J&K RTI portal account to view the applicationâs current status and to submit/track the First Appeal with all annexures, including the PIOâs order and proof of receipt date to compute deadlines. Retain the portal acknowledgments, PDFs of filings, and delivery receipts, as these are required enclosures for appeals/complaints before the Commission.
Why the reply is challengeable
- RTI is an access-to-records law; when a PIO offers narratives or conclusions without supplying underlying documents, the reply is deficient and is a valid ground for First Appeal seeking the specific records and certified copies.
- If the subject matter partly lies with another authority (e.g., RDD Achabal), the proper statutory course is transfer under Section 6(3) within five days rather than disposing the request without facilitating access, which is a ground to seek directions from the FAA.

Dear @Fayaz
