Section 95 of BNS: Protection of Children from Criminal Exploitation

Section 95 of the Bharatiya Nyaya Sanhita (BNS) applies when a person hires, employs, or engages a minor to commit any offense.

This section ensures that minors are protected from being exploited or used in criminal activities and imposes strict penalties on those who involve them in crimes.

Punishment: Whoever hires, employs, or engages a minor to commit an offense shall be punished with imprisonment of no less than three years, which may extend to ten years, and a fine.

If the offense is actually committed, the offender shall also be punished as if they committed the crime themselves.

Explanation: This section also covers hiring, employing, or using a minor for severe exploitation or creating illicit materials, which is considered a severe offense under this law.

How It Protects: This section safeguards minors from exploitation and criminal activities, ensuring that adults who exploit them for illegal purposes face serious legal consequences. It reinforces the protection of minors and promotes their welfare and safety.

Example: If a person forces a minor to steal or transport illicit contraband, they are guilty under this section.
