Who are migrants in jk? Can a person be a migrant in its own tehsil shifting from a village to town of same tehsil

Can a man get a migrant certificate and benfitted in getting a job under migrant cota in j&K if they have shifted from a village to town of the same tehsil

Dear @Rava_TaaRa

No, a person shifting from a village to a town within the same tehsil in J&K does not qualify as a migrant for obtaining a migrant certificate or availing job benefits under the migrant quota. Migrant status in J&K typically applies to those displaced due to conflict, like Kashmiri migrants registered with the Relief and Rehabilitation Commissioner (Migrants), not intra-tehsil moves. Such local shifts do not meet the residency or registration criteria for migrant quotas in jobs.

For ordinary shifting within the same tehsil or district, the relevant documents are usually domicile/permanent resident type certificates issued by the Tehsildar or similar authority, not a migrant certificate.

These domicile certificates can help in accessing local reservations meant for domiciles of J&K, but they are different from the special Kashmiri migrant quota, which is only for registered migrants as defined above

For confirmation, contact the Tehsildar office in your tehsil or Relief Commissioner (Migrants) at Jammu or visit jk.gov.in for domicile/migrant rules. If needed, apply for a standard domicile certificate if eligible via 15-year residency proof.

Which department is authorise to give the migrant certificate? What are documents required in order to get the migrant certificate?

Dear @Rava_TaaRa

In J&K, the authorised department for issuing migrant (migration) certificates for Kashmiri migrants and displaced persons is the Office of the Relief & Rehabilitation Commissioner (Migrants), J&K (DMRRR), functioning through its online portal and camp offices in Jammu/Srinagar.

Typical documents required when applying for a migrant/migration certificate (job/education purpose) include:

  • Existing migrant registration certificate or proof of registration as a migrant/displaced person (if already registered).
  • Permanent Resident / domicile-related proof of J&K, if available.
  • Proof of present residence (Aadhaar, ration card, voter ID, electricity bill, etc.).
  • ID proof and recent photographs.
  • Any supporting orders/letters showing you or your family are treated as migrants by a competent authority (Relief Commissioner, DC, etc.).

You can apply or see exact document list by:

  • Visiting the Relief Commissioner (Migrants) portal: rrcm.jk.gov.in → Services → “Application for Migration Certificate for Job/Education Purpose”.
  • Or contacting the Relief Commissioner (Migrants) office/camp office in your district for the latest checklist and format.

If the office refuses to accept your application or delays unreasonably, you may:

  • File a grievance on JK-IGRAMS (jkgrievance.in) choosing Department “DMRRR / Relief & Rehabilitation (Migrants)”.
  • If still unresolved, escalate to the Lieutenant Governor’s Grievance Cell through the same portal.

Can you explain the consequences on the issuance of fraudulent migrant certificate and job has been granted to a person on behalf of migrant certificates

Dear @Rava_TaaRa

Using a fraudulent migrant certificate to obtain a job is a serious offence. If such fraud is discovered, the main consequences can be:

1. Job consequences:

Appointment can be treated as void from the beginning and terminated/dismissed without retaining any service benefits, once it is proved that a fake/forged certificate was used to secure the job.

In schemes for Kashmiri migrants, government orders specifically allow cancellation of appointment and migrant registration if fake/forged documents are detected at any time.

2. Criminal liability:

The person who uses a fake migrant certificate, and officials who help in issuing/accepting it, may face FIR and prosecution for cheating and forgery offences (for example, Sections 420, 467, 468, 471, 120B of IPC/RPC in J&K) which can lead to imprisonment and fines.

Crime Branch J&K has filed charge-sheets and arrested persons for impersonating as migrants or using forged documents to claim migrant benefits or jobs.

3. Other effects: Recovery of salary or benefits wrongly taken, and debarment from future government jobs or schemes may also follow, depending on the departmental rules and court directions.

If you suspect someone has got a job on a fraudulent migrant certificate:

  1. Submit a written complaint with evidence (copy of certificate, appointment order, your proof, witness details) to the appointing department and to the Relief & Rehabilitation Commissioner (Migrants), J&K.
  2. Simultaneously, lodge a complaint with Crime Branch / local police station for cheating and forgery, and track the FIR number.
  3. If the department does not act, file an online grievance on JK-IGRAMS (jkgrievance.in) selecting the concerned department, and if needed, escalate to the Lieutenant Governor’s Grievance Cell.
