Using a fraudulent migrant certificate to obtain a job is a serious offence. If such fraud is discovered, the main consequences can be:

1. Job consequences:

Appointment can be treated as void from the beginning and terminated/dismissed without retaining any service benefits, once it is proved that a fake/forged certificate was used to secure the job.​

In schemes for Kashmiri migrants, government orders specifically allow cancellation of appointment and migrant registration if fake/forged documents are detected at any time.​

2. Criminal liability:

The person who uses a fake migrant certificate, and officials who help in issuing/accepting it, may face FIR and prosecution for cheating and forgery offences (for example, Sections 420, 467, 468, 471, 120B of IPC/RPC in J&K) which can lead to imprisonment and fines.​

Crime Branch J&K has filed charge-sheets and arrested persons for impersonating as migrants or using forged documents to claim migrant benefits or jobs.​

3. Other effects: Recovery of salary or benefits wrongly taken, and debarment from future government jobs or schemes may also follow, depending on the departmental rules and court directions.​

If you suspect someone has got a job on a fraudulent migrant certificate:

  1. Submit a written complaint with evidence (copy of certificate, appointment order, your proof, witness details) to the appointing department and to the Relief & Rehabilitation Commissioner (Migrants), J&K.
  2. Simultaneously, lodge a complaint with Crime Branch / local police station for cheating and forgery, and track the FIR number.
  3. If the department does not act, file an online grievance on JK-IGRAMS (jkgrievance.in) selecting the concerned department, and if needed, escalate to the Lieutenant Governor’s Grievance Cell.
