Section 223 of BNS: Enforcing Compliance with Public Authority Orders

Section 223 of the Bharatiya Nyaya Sanhita (BNS) applies when a person knowingly disobeys an order issued by a lawfully authorized public servant, instructing them to either refrain from an act or take specific action regarding property under their control.

This section ensures compliance with legal directives and prevents actions that could endanger public order or safety.

Punishment:
If disobedience causes obstruction, annoyance, or injury to a lawfully employed person Imprisonment of up to six months, or fine up to ₹2,500, or both.

If disobedience causes danger to human life, health, safety, or leads to a riot or affray Imprisonment of up to one year, or fine up to ₹5,000, or both.

Explanation:
It is not necessary for the offender to intend to cause harm.

If they knew about the order and their disobedience resulted in harm or posed a risk, they will be held liable under this section.

Illustration:
If a public servant lawfully prohibits a religious procession from passing through a certain street to prevent conflict, but a person knowingly violates this order, leading to a riot, they are guilty under this section.

How It Protects:
This section ensures law and order by penalizing those who violate official directives.

It prevents riots, public disturbances, and threats to public safety by ensuring compliance with legally issued orders.

Example:
If the police impose restrictions on a protest route and someone violates it, causing clashes, they are liable under this section.

Similarly, if someone disregards an official quarantine order, putting public health at risk, they can be prosecuted.
