This is to bring to your urgent attention the severe sanitation crisis prevailing in the Nariyalwadi, Sant Savta Marg, Mazgaon, Mumbai-400010. Despite multiple complaints, including a formal WhatsApp complaint submitted on 23rd April 2025, there has been no action taken by BMC to address the continuous garbage accumulation in House Galli. The situation has worsened to the extent that filthy water from the waste overflow is contaminating the surroundings, exposing residents to serious health hazards.
It is BMC’s statutory duty to ensure sanitation in residential areas by builders and housing societies. However, despite repeated complaints, no official notice has been issued to the responsible parties, namely the builder M/s NAN Enterprises & Partners and Ashiyana Co-operative Housing Society managing the Transit Camp. Instead, BMC officials left after informally accepting assurances from builder representatives, which constitutes negligence and failure to act in the public interest.
Key Violations and Concerns:
Violation of Public Health Regulations – Unchecked waste accumulation has led to high risk of disease outbreaks, including dengue, malaria, and respiratory infections.
Negligence by Builder & Society – They have failed to maintain proper sanitation despite being responsible for waste management.
Failure of BMC Officials to Enforce Regulations – Instead of serving notices, they abandoned their responsibility after informal assurances, which compromises public safety.
Immediate Actions Demanded:
Issue a formal notice to the builder and housing society for gross negligence and failure to comply with health and sanitation guidelines.
Conduct an urgent sanitation inspection and penalize responsible parties for failure to maintain hygiene standards.
Deploy municipal cleaning staff immediately to remove garbage and prevent further contamination.
Ensure future compliance with scheduled waste removal inspections in Transit Camp to avoid recurrence.
The residents of Nariyalwadi Transit Camp have a fundamental right to clean living conditions, and any negligence in addressing this crisis could lead to legal consequences for BMC and the concerned authorities. If no action is taken within the next seven days, we will be compelled to escalate this matter to higher authorities and seek legal recourse.
