If you are facing issues with services related to Paying Guest (PG) accommodations or hotels, it’s essential to know the appropriate channels to file a complaint. Here’s a step-by-step guide to help you to resolve the dispute.
Note: Before escalating the matter, try addressing your concerns directly with the PG owner or hotel management. Often, issues can be resolved amicably through open communication.
1. Keep Necessary Documentation
Collect all relevant documents that support your complaint, such as:
- Receipts or invoices
- Written agreements or contracts
- Photographs or videos evidencing the issue
- Correspondence records (emails, messages) with the service provider
2. Send a Formal Legal Notice
If direct communication doesn’t yield results, you may draft and send a formal legal notice to the service provider, detailing your grievances and the resolution you seek. You can represent your intent to pursue the matter legally if not resolved.
3. Lodge a Complaint with the National Consumer Helpline (NCH)
The NCH is a government initiative to assist consumers in resolving grievances. To file a complaint:
- Visit the NCH portal: National Consumer Helpline (https://consumerhelpline.gov.in)
- Register or log in to your account.
- Submit your complaint by providing detailed information about the issue and attaching supporting documents.
4. Approach the Consumer Disputes Redressal Commission
If the issue remains unresolved, you can escalate the matter to the appropriate Consumer Disputes Redressal Commission based on the monetary value involved:
- District Commission: For claims up to ₹1 crore.
- State Commission: For claims between ₹1 crore and ₹10 crores.
- National Commission: For claims exceeding ₹10 crores.
Steps to File a Complaint:
- Draft the Complaint: State the facts, the relief sought, and any evidence supporting your claim.
- Attach Documents: Include copies of all relevant documents.
- Pay the Prescribed Fee: The fee varies based on the claim amount.
- Submit the Complaint: File it in person or through the E-DAAKHIL portal at the appropriate commission.
5. Utilize the Centralized Public Grievance Redress and Monitoring System (CPGRAMS)
For grievances related to government-run accommodations or services, you can file a complaint through CPGRAMS Portal and submit your grievance with all pertinent details.
6. Lodge a Police Complaint or Get Legal Help
If the disputed matter includes harassment or violation of civil or criminal laws, you can lodge a police complaint against the PG owner or hotel at the nearest local police station or CCTNS portal of the respective state police.
